Court Catches Elusive Father On Facebook
An Australian man has been served paternity test orders via Facebook after multiple notices mailed to his various home addresses never received a reply.
The man, known as Mr. Howard, was involved in a brief relationship with a woman who later gave birth. The mother then applied for child support assessment but her application was rejected because no father had been named on the child's birth certificate and there was no proof of paternity.
The mother's lawyer then repeatedly mailed Mr. Howard, asking him to undergo a paternity test, but the letters received no reply and Mr. Howard changed addresses frequently.
After Adelaide federal magistrate Steve Brown was informed that Mr Howard was a regular Facebook user, he ordered the documents to be served to him electronically.
Mr. Howard closed his Facebook and Myspace accounts and still did not reply. Magistrate Brown then passed the judgement that he was satisfied with the procedure and ruled that the mother was entitled to child support payments payable by Mr. Howard.
Legal systems are increasing expanding their reach across all media. In 2008, a Canberra law firm used Facebook to serve notices on two loan defaulters.
